Tax law is the most complex set of regulations any Australian business must comply with. Tax issues affect nearly every strategic business decision you make, including how to best structure your business, sale and purchase of business or assets and raising capital. Even when you have a deal which you don’t believe raises major tax issues, you need a lawyer who knows for certain whether it does.
Tax is often imposed on transactions even though the taxpayer doesn’t receive any money. For example, if you transfer an asset from a trust to a company which you control to restructure your business, you may be liable for one or more of Capital Gains Tax, GST and Stamp Duty if you structure the deal in the wrong way. This is particularly so in the case of property developments where two or more parties are involved.
